Welcome to Airbags by Hit-Air. These Terms of Service ("Terms") govern your use of our website, including airvest.com, and your purchase and use of products offered through our online store.

By accessing or using this website, placing an order, or purchasing products from us, you agree to these Terms. If you do not agree with these Terms, please do not use this website or purchase products from us.

1. About Hit-Air Vest USA

Hit-Air Vest USA is an authorized U.S. distributor of Hit-Air® wearable airbag protection systems, which are developed and manufactured by Mugen Denko Co., Ltd. in Japan.

Hit-Air Vest USA is a distributor and retailer and is not the manufacturer of Hit-Air products.

The Hit-Air® name, trademarks, product designs, technology, images, and related intellectual property belong to their respective owners, including Mugen Denko Co., Ltd. Nothing on this website transfers ownership of any Hit-Air intellectual property to you.

Our products are sold for use in accordance with the manufacturer's instructions and applicable product documentation.

2. Safety Equipment

Hit-Air products are safety equipment designed to provide additional protection in the event of certain accidents or falls. They are not intended to eliminate the risk of injury or death.

No airbag system can guarantee protection from every type of accident, impact, injury, or death.

Customers are responsible for reading and following all applicable Hit-Air user manuals, safety instructions, warnings, maintenance requirements, and product-specific instructions before using a Hit-Air product.

Proper installation, adjustment, maintenance, storage, and use of the product are essential to its intended operation.

Customers should inspect their equipment regularly and should discontinue use if the product shows signs of damage, deterioration, malfunction, or improper deployment.

Hit-Air recommends inspection by an authorized distributor or dealer when a product has experienced a significant impact or when damage or deterioration is suspected.

3. CO₂ Cartridges and Airbag Activation

Hit-Air airbag systems use CO₂ cartridges to inflate the airbag system when properly activated.

Only the correct CO₂ cartridge specified for the particular Hit-Air model and size should be used.

Use of non-genuine or incorrect CO₂ cartridges may cause the airbag to malfunction, fail to deploy properly, or deploy improperly.

Customers are responsible for confirming that they purchase and use the correct genuine Hit-Air CO₂ cartridge for their particular product.

Mugen Denko has advised customers to use genuine Hit-Air CO₂ cartridges designed and tested for Hit-Air products. The use of non-genuine cartridges may affect proper deployment and may not be covered by the manufacturer's warranty.

CO₂ cartridges are regulated for transportation and may be subject to shipping restrictions. Shipping methods may vary depending on the destination and applicable transportation regulations.

4. Proper Use of the Airbag System

Hit-Air products must be used according to the manufacturer's instructions.

For tether-activated Hit-Air systems, the activation tether must be properly connected to an appropriate fixed attachment point on the motorcycle, horse saddle, or other approved equipment, depending on the product and intended application.

The tether must not be attached in a manner that prevents proper operation of the airbag system.

Customers are responsible for selecting a product appropriate for their intended activity and for ensuring that the product is correctly fitted and used.

If you are uncertain about product compatibility, sizing, tether configuration, CO₂ cartridge size, or proper use, please contact Hit-Air Vest USA before using the product.

5. Product Life and Maintenance

Hit-Air products are safety equipment and have a limited service life.

Mugen Denko recommends replacing Hit-Air products after approximately three to five years of use at the longest, even when no obvious damage is visible. Actual service life may be affected by use, storage conditions, exposure to environmental conditions, accidents, and other factors.

Customers should follow the manufacturer's current recommendations regarding inspection, maintenance, repair, and replacement.

Products that have experienced a significant accident, impact, deployment, or other potentially damaging event should be inspected by an authorized Hit-Air distributor or dealer before being returned to service.

6. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, pricing, sizing information, and other information displayed on our website are accurate and current.

However, product specifications, colors, materials, features, availability, and packaging may change from time to time as a result of manufacturer updates or other circumstances.

Product photographs may also appear differently depending on your device, monitor, lighting, or other factors.

We reserve the right to correct errors, update product information, and modify product availability or pricing without prior notice.

7. Orders and Acceptance

Placing an order through our website constitutes an offer to purchase the selected products.

We reserve the right to accept or decline an order for any lawful reason, including product availability, pricing errors, suspected fraud, shipping restrictions, or other order-related concerns.

An order confirmation does not necessarily constitute acceptance of an order. We may cancel or modify an order when necessary and will provide notice when reasonably possible.

If an order is canceled after payment has been processed, the applicable amount will be refunded.

8. Pricing and Payment

All prices displayed on our website are in U.S. dollars unless otherwise stated.

Applicable sales tax will be calculated and collected as required by law.

Payment must be successfully processed before an order is shipped.

We reserve the right to correct pricing errors and to cancel orders placed at an incorrect price when permitted by applicable law.

9. Shipping

We ship products to destinations indicated on our website and through available shipping methods.

Estimated delivery dates are estimates only and are not guarantees.

Once an order has been transferred to the shipping carrier, delays caused by the carrier, weather, transportation interruptions, customs, or other circumstances outside our reasonable control may occur.

Certain products, including CO₂ cartridges, may be subject to special transportation or hazardous-material shipping requirements.

Customers are responsible for providing a complete and accurate shipping address.

We are not responsible for delays or additional costs resulting from an incorrect or incomplete address supplied by the customer.

10. Returns and Refunds

Returns are subject to our separate Return and Refund Policy, which is incorporated into these Terms by reference.

Certain safety equipment may be subject to additional return restrictions because of its nature as protective equipment.

Products must be returned in the condition required by our Return and Refund Policy in order to qualify for a refund.

Used, worn, deployed, damaged, altered, or improperly handled safety equipment may not be eligible for return.

CO₂ cartridges may be subject to additional return and shipping restrictions.

Nothing in this section limits any non-waivable rights a customer may have under applicable law.

11. Manufacturer's Warranty

Hit-Air products may be covered by the manufacturer's limited warranty provided by Mugen Denko Co., Ltd.

Warranty coverage is subject to the manufacturer's applicable warranty terms, including requirements relating to proof of purchase, product condition, proper use, and authorized inspection or repair.

Mugen Denko's published warranty information provides coverage for qualifying manufacturing defects and identifies exclusions including normal wear and tear, damage resulting from improper use or failure to follow instructions, accident-related damage, improper storage, and unauthorized repairs.

Where applicable, Hit-Air Vest USA will assist customers with the warranty process.

The manufacturer's warranty does not necessarily cover the cost of a CO₂ cartridge used during deployment or other costs not specifically covered by the manufacturer's warranty.

12. Repairs and Modifications

Hit-Air airbag systems contain specialized safety components.

Customers should not modify, disassemble, repair, or alter an airbag system except as specifically authorized by Hit-Air or an authorized Hit-Air distributor or dealer.

Repairs or modifications performed by unauthorized persons may affect product operation and may void applicable warranty coverage.

Please contact Hit-Air Vest USA before attempting repairs or modifications to an airbag system.

13. Assumption of Risk

Participation in motorcycle riding, horseback riding, motorsports, and other activities for which Hit-Air products may be used involves inherent risks, including the risk of serious injury or death.

The purchase or use of a Hit-Air product does not eliminate these risks.

Customers are responsible for making their own decisions regarding whether and how to participate in an activity and for using appropriate protective equipment and following applicable safety practices.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Hit-Air Vest USA and its owners, officers, employees, agents, distributors, and representatives shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the purchase, use, inability to use, or performance of any product sold through this website.

To the fullest extent permitted by applicable law, our total liability arising from a purchase shall not exceed the amount actually paid by the customer for the product giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

15. No Guarantee of Injury Prevention

Hit-Air products are designed to provide additional protection in certain accident scenarios. However, we do not represent or guarantee that a Hit-Air product will prevent injury, reduce the severity of every injury, prevent death, or operate successfully in every accident or circumstance.

Product performance depends on numerous factors, including proper fitting, correct installation, correct tether attachment, proper maintenance, product condition, accident circumstances, and use of the correct CO₂ cartridge.

Customers should never rely on an airbag system as a substitute for responsible riding practices or other appropriate protective equipment.

16. Intellectual Property

All content on this website, including text, photographs, graphics, logos, product information, videos, designs, and other materials, is owned by or licensed to Hit-Air Vest USA or the applicable intellectual-property owner and is protected by applicable intellectual-property laws.

Hit-Air®, Mugen Denko®, product names, logos, and related marks may be trademarks or registered trademarks of their respective owners.

You may not reproduce, modify, distribute, publish, sell, or commercially exploit website content without prior written authorization.

You agree to use this website only for lawful purposes.
